Clarification on the mother and egg

Was It a Mitzvah?

by Gutman Locks

A Reader asked if it was a mitzvah when I sent the mother bird away.

When the bird laid her egg in my bedroom, my house “acquired” the egg. A house is a guarded, private, place so things left there without permission have the legal status of having been acquired. This is true unless previous to this I had specifically stated that I do not want my property to acquire such things. If that would have been the case then my property would not have acquired it for me. Therefore, the egg was already mine when the mother was sent away, so there was no mitzvah of sending her away. I got the egg, but not the mitzvah.
